1. Service Description

FitCoach AI is an AI-powered fitness and nutrition coaching application that provides personalized workout plans, meal guidance, and progress tracking. The service uses DeepSeek artificial intelligence to generate recommendations based on your profile and goals, following evidence-based guidelines from the American College of Sports Medicine (ACSM), National Strength and Conditioning Association (NSCA), American Council on Exercise (ACE), and the U.S. Dietary Guidelines for Americans 2020-2025. FitCoach AI is a general wellness and informational tool — it is NOT a medical service, healthcare provider, clinical nutrition service, or substitute for professional medical, fitness, or nutritional advice.

2. Eligibility

You must be at least 13 years of age to use FitCoach AI, in compliance with the Children's Online Privacy Protection Act (COPPA). By creating an account, you confirm that you meet this age requirement.

• If you are between 13 and 17 years of age, you must have parental or guardian consent before using this service. We strongly recommend parental supervision when minors use AI-generated fitness and nutrition features, and consultation with a pediatrician before starting any new exercise or dietary program.
• If you are 18 or older, you represent that you have the legal capacity to enter into this agreement.

We reserve the right to terminate accounts of users who do not meet these eligibility requirements.

3. Health & Physical Readiness Screening

In alignment with ACSM and ACE pre-participation health screening guidelines, we strongly recommend that all users:

• Complete a PAR-Q (Physical Activity Readiness Questionnaire) before beginning any new exercise program. The PAR-Q is a standard health screening tool developed to identify individuals who should seek medical clearance before increasing physical activity.
• Obtain physician clearance if you have a history of cardiovascular disease, hypertension, diabetes, musculoskeletal injuries, respiratory conditions, pregnancy, or any other condition that may be affected by exercise.
• Consult a Registered Dietitian (RD) or Registered Dietitian Nutritionist (RDN) before making significant dietary changes if you have a medical condition, chronic illness, eating disorder history, or are pregnant or breastfeeding.

FitCoach AI does not conduct health screenings on your behalf and cannot assess your individual medical fitness for exercise. You assume sole responsibility for ensuring you are medically fit to participate in any exercise or dietary program generated by this service.

4. Acceptable Use

By using FitCoach AI, you agree to:

• Use the service only for its intended purpose of personal fitness and nutrition guidance.
• Provide accurate information in your profile and during onboarding.
• Not attempt to abuse, exploit, reverse-engineer, or circumvent any part of the service.
• Not use the service to harm yourself or others.
• Not attempt to access other users' data or accounts.
• Not submit false, misleading, or malicious content to the AI.
• Not attempt to instruct the AI to override its built-in safety guidelines or generate prohibited content.
• Comply with all applicable U.S. federal, state, and local laws and regulations in your use of the service.
• Comply with DeepSeek's API Terms of Service as they apply to end users of AI-powered applications.

5. Medical & Health Disclaimer

FitCoach AI is not a medical service and is not regulated as a medical device by the U.S. Food and Drug Administration (FDA). This service falls within the FDA's General Wellness Policy guidance (August 2016) as a general wellness application intended to maintain or encourage a general state of health. The AI-generated workout plans, nutrition guidance, and coaching responses are for general informational and educational purposes only.

• Nothing on this platform constitutes medical advice, diagnosis, or treatment.
• Nothing on this platform constitutes clinical nutrition therapy or a medical diet prescription.
• AI-generated calorie and macronutrient targets are estimates and may not be appropriate for your specific medical or health circumstances.
• You assume full responsibility for any health or fitness decisions you make based on content from FitCoach AI.

We strongly encourage you to consult a qualified physician, certified personal trainer, or registered dietitian before starting any new fitness or dietary program.

6. AI Limitations & Disclosure

In compliance with FTC guidance on AI transparency and truthful advertising:

• FitCoach AI uses DeepSeek large language model (LLM) technology to generate responses and plans. All coaching content, workout plans, and nutrition plans are AI-generated.
• AI can and does make mistakes. Generated content may be inaccurate, incomplete, or inappropriate for your specific circumstances.
• The AI does not know your complete medical history and cannot perform a physical assessment.
• You should independently verify any recommendations — particularly those relating to exercise form, caloric targets, or nutritional information — with a qualified professional before acting on them.
• We make no warranty that AI-generated content is accurate, up-to-date, or suitable for your individual needs.

7. Account and Data

You are responsible for maintaining the security of your account credentials. You may delete your account at any time by visiting Settings > Account Management. Account deletion is permanent and irreversible — all your data, including your profile, messages, plans, and progress logs, will be immediately and permanently deleted. 8. Intellectual Property

The FitCoach AI name, logo, interface, and underlying software are the intellectual property of FitCoach AI and its licensors. You may not copy, modify, distribute, or create derivative works from any part of the service without our prior written consent. AI-generated plans and responses delivered to you through the service may be used by you for your personal, non-commercial fitness purposes.

9. Limitation of Liability

To the maximum extent permitted by applicable U.S. law, FitCoach AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to physical injury, illness, or harm resulting from following AI-generated fitness or nutrition recommendations. Your use of the service is at your own risk. FitCoach AI is provided "as is" without warranties of any kind, express or implied, including warranties of fitness for a particular purpose or merchantability.

10. Changes to Terms

We reserve the right to update these Terms of Service at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of FitCoach AI after changes to the Terms constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the service and delete your account.

11. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the United States of America and, to the extent applicable, the laws of the state in which FitCoach AI operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall first be subject to good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), to the extent permitted by applicable law. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
